Assessment of Compensation Awards in Personal Injury Claims in Nigeria

This study assessed the pattern and adequacy of compensation awards in personal injury claims in Nigeria. Court judgments and questionnaire responses from lawyers and claimants were analysed using descriptive statistics. The findings revealed that compensation awards were characterised by inconsistency, limited heads of damage, and often conservative figures that inadequately reflected losses and suffering, while procedural delays affected access to recovery. The study observed low use of actuarial evidence. It recommends principled assessment guidelines, use of expert evidence, and procedural reforms to expedite claims.
