Assessment of Judicial Review on the Protection of Fundamental Rights in Nigeria
Law — 2025, Undergraduate
This study assessed the role of judicial review in the protection of fundamental rights in Nigeria. Court judgments, constitutional provisions, and interview responses from legal practitioners were analysed using qualitative and descriptive methods. The findings revealed that judicial review provided an effective mechanism for challenging rights violations and holding authorities accountable, although delays, enforcement difficulties, and access barriers limited its protective reach. The study observed inconsistent application of rights jurisprudence. It recommends procedural reforms, strengthened enforcement, and enhanced access to legal aid.
