Effect of Marriage Laws on the Rights of Spouses in Nigeria

This study examined the effect of marriage laws on the rights of spouses in Nigeria. Statutory provisions, judicial decisions, and questionnaire responses from married persons and legal practitioners were analysed using descriptive methods. The findings revealed that the legal regime governing marriage affected property rights, custody, maintenance, and divorce proceedings, with differences between statutory and customary marriages producing varied protections. The study observed that women's rights, particularly under customary unions, were less protected. It recommends harmonisation of marriage laws, clear recognition of marital rights, and accessible dispute resolution.
